Good partnerships (or collaborative relationships) can bring about more opportunities and success. However, it is advisable to be aware of the potential risks associated with them, and careful attention must be paid to the relevant regulations, particularly the competition law, such as the Fair Trade Act in Taiwan. In addition, recent updates to the Act of Gender Equality in Employment have imposed additional responsibilities on employers to prevent and address instances of sexual harassment.
At this event, three legal experts will provide updates on the latest developments in fair trade and risks associated with distribution/agency agreements, and gender equality law. The event will consist of three presentations on the respective topics, followed by a Q&A session. It should be of great benefit to members in the retail and luxury goods industries.
Topic 1 – Fair trade law: In this presentation, the speaker will explain legal issues from the perspective of the Fair Trade Act in the areas of retail and distribution.
Topic 2 – Distribution/agency agreements: While distribution/agency agreements could open a lot of doors for both brands and distributors/agents, they could also expose both parties to unexpected risks. In this presentation, the speaker will share some real-world cases or examples of contractual disputes, and provide practical tips and insights on how draft, negotiate, and enforce distribution/agency agreements.
Topic 3 – Gender equality law: With the updates to the Act of Gender Equality in Employment, the speaker will introduce the latest requirements regarding the employers' responsibility to prevent and deal with sexual harassment.
About the speakers
Fang-yi Jen (任芳儀) is a Partner at Baker McKenzie. Her practice focuses on competition matters including leniency applications, multinational merger control regulations, negotiations with competition authorities, and investigations. She also has extensive experience in advising local and foreign corporations on mergers and acquisitions, general commercial transactions and corporate compliance matters.
Joanna Ouyang (歐陽漢菁) is a Partner at Baker McKenzie. She is a former Taipei District Court and Intellectual Property Court judge. With her extensive litigation experience as well as exceptional legal knowledge and skills, she has many times turned the table for cases with an unfavourable history or prospects, securing a satisfactory outcome for clients since she joined Baker & McKenzie.
Pamela Tsai (蔡維恬) is a Partner at Baker McKenzie. She has substantial experience in labour and employment law matters, focusing on assisting and representing local and foreign corporations in employment and compensation matters, including labour disputes, harassment/discrimination investigations, compliance of employment regulations and employment issues in merger and acquisition transactions.
